These Terms of Service ("Terms") outline the rules and expectations for using the ARKYVS website and engaging our creative services. By accessing our website or entering into a service agreement with us, you agree to these Terms.

1. About ARKYVS

ARKYVS is a creative production studio offering video, photo, and content direction services. We work with brands, creators, and businesses to deliver cinematic, story-driven media aligned with strategic goals.

2. Scope of Services

Our services may include:

  • Video production

  • Photography

  • Content strategy

  • Editing and post-production

  • Creative direction

  • Related deliverables outlined in custom proposals or packages

Project terms, deliverables, timelines, and payment details are agreed upon in writing via proposal, estimate, or email.

3. Client Responsibilities

To complete your project on time and to spec, you agree to:

  • Provide accurate and timely information

  • Respond to creative drafts and edit requests within the agreed timeline

  • Supply all necessary brand assets (logos, voiceovers, etc.)

  • Secure any required third-party permissions (e.g. location, talent) unless otherwise agreed

Delays caused by missing client inputs may extend timelines or impact deliverables.

4. Payments & Booking

  • A non-refundable deposit is required to secure any project date

  • Full payment is due according to the schedule in your invoice or agreement

  • Late payments may incur a service charge or delay delivery

  • Payment methods include ACH, credit card, or other approved platforms

All pricing is subject to applicable local taxes unless otherwise stated.

5. Revisions & Rescheduling

  • Packages typically include 3 rounds of revisions unless stated otherwise

  • Additional revisions are billed separately

  • Reschedules must be requested at least 72 hours in advance

  • Cancellations made within 48 hours of a shoot date may be subject to a fee or forfeiture of deposit

6. Intellectual Property

  • Final deliverables are licensed to the client for commercial or personal use, depending on the project scope

  • Raw files remain the property of ARKYVS unless separately licensed or agreed upon in writing

  • ARKYVS reserves the right to display completed work in portfolios, reels, or social media unless a written confidentiality agreement is in place

7. Content Usage & Platform Rights

Clients are responsible for ensuring that distributed content complies with platform guidelines (e.g., Instagram, YouTube) and applicable regulations (e.g., FTC endorsements, ADA captioning). ARKYVS is not liable for takedowns, strikes, or performance outcomes related to platform policies.

8. Liability Limitations

While we aim to deliver exceptional quality, ARKYVS is not liable for:

  • Indirect, incidental, or consequential damages

  • Delays caused by third-party vendors, weather, or client reschedules

  • Technical errors beyond our control (equipment failure, platform outages)

Total liability is limited to the amount paid for the specific service or deliverable.

9. Confidentiality

Any proprietary information you share with ARKYVS will be kept confidential and used solely for your project. We do not share your project details or materials with third parties without consent, unless required by law.

10. Termination

Either party may terminate a service agreement with written notice. If ARKYVS terminates the agreement, any unused payments will be refunded proportionally. If the client terminates, any completed work will be billed accordingly, and deposits are non-refundable.

11. Governing Law

These Terms are governed by the laws of the state or country in which ARKYVS operates. Any disputes will be resolved under local jurisdiction, through mediation before legal action if possible.
